With reference to your letter of the
6th September regarding the Law Officer's opinion on the Hong Kong piracy case, I understand that
the Treasury Solicitor has written to the Treasury
offering to bear the costs on his vote, and quoting
precedents, and that he is waiting for the Treasury
reply. You will note that it is not now a question
of the costs of an appeal from the Hong Kong Court
to the Privy Council, but of a special reference by the Secretary of State to the Judicial Committee
under Section 4 of the Judicial Committee Act, 1833.
